Very often we are – but, as land buyers, we have certain boxes that prospective plots need to tick.

Based in Evesham, we buy land in Worcestershire, Gloucestershire, Warwickshire and Herefordshire. We buy land in Birmingham, too, though as with all parcels of land that we make an offer on, it needs to be big enough for at least one dwelling.

We need to be able to see value in a potential development project before buying land – some sites are better suited to new homes than others.

Other factors that help us decide include:

  • The local area: does the location have an enviable reputation – the first indication that we may get a favourable response from prospective buyers once the development is finished?
  • Is there good access? Land that is tucked away in a tight corner between multiple homes can be challenging to work with. Access also extends to a parcel of land’s proximity to infrastructure and services: property owners typically want homes close to existing roads – though there are exceptions.
  • Do we feel we will quickly be able to secure planning permission?
  • Who is selling the land? If an estate agent or land agent is involved, for example, this can often affect the process.

If the land has planning permission, then land purchasing is similar to the process of buying a house. However, there are things called ‘options’ and ‘conditional contracts’ that differ from a house purchase.

Absolutely – please try us. Most of the land we buy does not already have planning permission. Planning legislation can be complex and time-consuming, which is why people often prefer to sell land to us rather than develop it themselves.

There is a term known as ‘residual land value’ – this basically means the value of the land after all costs. The land value is worked out by taking your GDV (gross development value) minus build costs minus legal costs = residual land value.

Another key element is what we call ‘development potential’, which is more subjective. We do, however, aim to be as honest and fair as possible with every offer we make.

This varies from case to case. You could be liable for capital gains tax: your solicitor will be able to advise you further prior to selling. They will also be able to give you other valuable insight about the land buying process from a tax/financial point of view.

Yes. Much like selling a house, upon completion of selling land the outstanding debt will be settled by the solicitors handling the transaction, and you will receive the remaining funds.

Yes, you can. As with selling land you owe on (and much like selling a house), upon completion of selling land the outstanding lien debt will be settled by the solicitors that have been dealing with your transaction, and you will receive the remaining funds.

When we purchase land, the process can take anywhere from three months to several years. If the land already has planning permission in place, then the process is relatively straightforward and quick.

If the land doesn’t have planning permission and we pursue an option agreement, this will take more time due to the plans needing to be submitted to the local planning authority for approval.

This could be a classic ‘how long is a piece of string’ scenario, but we always give landowners regular updates throughout the process.

An option agreement is a legal agreement between a landowner and developer that allows the developer to try and gain planning permission.

The agreement protects the developer from the landowner selling the land whilst the viability studies and planning applications are undertaken. There is normally a three- or five-year timescale upon exercising the option.
